These terms and conditions ("Terms") govern your use of AssethubMarketplace, operated by Assethub Pte Ltd. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the Site.
1.1 All potential bidders must register at Assethubmarketplace.com before the auction. The Auctioneer may, in its sole discretion, deny registration to any person.
1.2 You will need to give us enough time to process and approve your account and registration. We may, at our option, decline to permit you an account or to register as a bidder.
1.3 You agree to provide accurate and complete information during the registration process and to update this information as necessary to keep it current. Failure to provide accurate information may result in Assethub reserving the right to void the won item listing or ban the user from the platform.
1.4 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
1.5 You must be at least 18 years old and capable of forming a legally binding contract to use the Site. By using the Site, you represent and warrant that you meet these eligibility requirements.
2.1 Our descriptions of any lot, condition reports, and any other statements made by us (whether verbally or in writing) regarding any lot, including its nature, condition, artist, period, materials, approximate dimensions, or provenance, represent our opinions and should not be considered factual statements. All dimensions and weights provided are approximate only.
2.2 We will not be responsible for any errors that may occur in the quality of digital images.
2.3 Bidders shall examine or inspect items prior to the auction. ALL ITEMS ARE SOLD AS IS, WHERE IS AND WITH ALL FAULTS, DEMAGES AND ERRORS IN DESCRIPTION. BIDDERS ARE DEEMED TO HAVE SATISFIED THEMSELVES AS TO THE CONDITION OF LOTS PRIOR TO BIDDING. NEITHER SELLER NOR ASSETHUB MAKES ANY WARRANTY, EXPRESS OR IMPLIED, AS TO THE NATURE, QUALITY, VALUE OR CONDITION OF ANY ASSET. ASSETHUB AND SELLER EXPRESSLY DISCLAIM ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
2.4 AssetHub may, in its discretion, offer the assets for sale by the piece or by the lot. The seller has the right to remove assets from the auction either before or after bidding has completed.
2.5 AssetHub and the seller assume no responsibility for, and make no representations or warranties concerning, descriptions of assets contained in marketing materials for the auction. It is the bidders’ obligation to verify such descriptions prior to the auction.
3.1 All lots are auctioned subject to minimum reserve prices if any.
3.2 By placing a bid on an item, you agree to purchase the item at the price you bid, plus any applicable fees. Also, you accept and agree that bids submitted in this way are final and that you may not, under any circumstances, amend, retract or revoke your bid. We are not responsible for any errors you make in bidding. Bids are binding contracts, and retracting a bid may result in account suspension and/or ban from all Assethub related sale.
3.3 Assethub reserves the right, in our absolute discretion: (i) to reject your registration to bid or purchase; (ii) to reject, revoke or refuse to accept any bid (even those that have been previously accepted); (iii) to withdraw or divide any lot or combine any two or more lots; (iv) whether during or after the sale, to restart or continue the bidding or sale even if the bidding or sale has completed; and/or (vi) in the case of error or dispute and whether during or after the sale, to continue the bidding or purchase, determine the successful bidder or buyer, cancel the sale of the lot, or re-offer and re-sell any lot. If any dispute relating to bidding arises during or after the sale, Assethub's decision in exercise of this option is final.
3.4 The record of sale (bidding log with regards to the auction) will be taken as absolute and final in all disputes. In the event of a discrepancy between any online records or messages provided to you and the record of sale, the record of sale will govern.
3.5 The extension of one lot's closing time does not affect other lots' closing times. Therefore, it is possible that lots will close out of numerical lot order.
3.6 The highest bid will be the successful bidder when the lot closes, unless Assethub decides to use its discretion as set out in clause 3.3 and 3.4 above. This means a contract for sale has been formed between the seller and the successful bidder.
3.7 AssetHub shall charge and collect from each successful bidder buyer's premium for each sale at the auction, in addition to the purchase price as bid. The specfic buyer's premium varies for each event and is stated at the Terms of Sales under the Information section of each event.
4.1 The Seller and AssetHub reserve the right to rescind any sale for any reason in which case the buyer’s sole remedy shall be the refund of the amount of the purchase price and any Buyer’s Premium actually paid. Neither AssetHub nor seller shall be liable for any damages of any type or nature (whether in contract, tort or otherwise) sustained or claimed by any bidder or any other person or entity in connection with the auction. Without limiting the foregoing, in no event shall the Auctioneer’s liability to any bidder for any act or omission occurring in connection with the auction exceed the amount that such bidder has actually paid to the Auctioneer as a deposit or as payment for a purchased item.
4.2 Each successful bidder must settle the payment in full immediately upon receiving the invoice. Failing which, AssetHub and the seller may resell the items in question without notice. Without limiting the foregoing, full payment of the purchase price is due prior to removal of any purchased assets. In the event that a bidder fails to pay the entire purchase price (in addition to the buyer’s premium and any applicable tax) within the time specified by AssetHub or otherwise fails to comply with these Terms and Conditions, AssetHub and the seller reserve the right to resell such items without notice, and the defaulting purchaser shall be liable to AssetHub and seller for any resulting deficiency, including costs incurred in storing and reselling the assets in question.
4.3 All items are sold subject to applicable tax or duties where applicable
4.4 Purchasers shall pay in the form of cash, bank’s transfer and cheque only. No credit card payment is allowed.
4.5 Subject to clause 4.2, all lots must be removed within 7 days after the auction.
